A Settlement[1] has been reached in a class action lawsuit about whether Sunshine Life & Health Advisors, LLC (“Sunshine Life & Health Advisors”) sent text messages to cellular telephone numbers without prior express written consent of the recipients as defined by the Florida Telephone Solicitation Act, Fla. Stat. § 501.059 (“FTSA”). Sunshine Life & Health Advisors denies the allegations and any wrongdoing. The Court has not decided who is right.

The Settlement offers payments to Settlement Class Members who file valid Claims.

Your legal rights are affected whether you act or do not act. Read the Notice carefully.

Your Legal Rights And Options In This Settlement
Submit A Claim Form

If you are a member of the Settlement Class, you must submit a completed Claim Form to receive a payment. If the Court approves the Settlement, becomes final and effective, and you remain in the Settlement Class, you will receive your payment by check. Your claim form must be received no later than November 19, 2022.
Exclude Yourself

You may request to be excluded from the Settlement and, if you do, you will receive no benefits from the Settlement. You must opt-out by the October 15, 2022, in order to preserve the claims you may have against Sunshine Life & Health Advisors that are being released or resolved as part of the Settlement.
Object

You can write to the Court by October 15, 2022 about why you don’t like the Settlement.
Go To A Hearing

You may ask the Court for permission to speak about the Settlement at the Fairness Hearing by including such a request in your written objection, which you must file with the Court and serve on Plaintiff’s Counsel and Sunshine Life and Health Advisor’s Counsel by October 15, 2022. The Fairness Hearing is scheduled for November 4, 2022 at 10:00 a.m. EST.
Do Nothing

You will not receive a payment if you fail to timely submit a completed Claim Form, and you will give up your right to bring your own lawsuit against Sunshine Life and Health about the Claims in this case.
